Terms of Service

These Terms of Service ("Terms") govern your use of Galexivo's products and services. By creating a Galexivo account you agree to these Terms.

1. The service

Galexivo provides art gallery management software as a subscription service. When you subscribe, we deploy a Galexivo instance to your Cloudflare account and provide you with access to the admin application, public gallery site, and related tools.

The specific features available to you depend on your subscription plan. Current plans and features are described at galexivo.com/pricing.

2. Your account

You must provide accurate information when creating your account. You are responsible for maintaining the security of your account credentials. Notify us immediately if you believe your account has been compromised.

You are responsible for all activity that occurs under your account, including the actions of staff members you grant access to.

3. Subscription and payment

Subscriptions are billed monthly or annually in advance. All payments are processed by Stripe. Prices are listed at galexivo.com/pricing and are subject to change with 30 days' notice.

If payment fails, we will attempt to charge the card on file for 7 days. If payment is not received, your account will be suspended. Your data remains intact in your Cloudflare account throughout the suspension and for 30 days after cancellation.

4. Your data

You own your gallery data. It is stored in your Cloudflare account. We do not claim any rights to your inventory, artwork photographs, collector information, or any other data you enter into Galexivo.

You are responsible for ensuring your use of Galexivo complies with applicable data protection laws, particularly regarding the personal data of your collectors and artists.

5. Acceptable use

You may not use Galexivo to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Transmit malicious code or interfere with the service
• Resell or sublicense access to Galexivo without our written permission
• Use the service in connection with the sale of counterfeit artworks

6. Intellectual property

The Galexivo application, including its code, design, and documentation, is our intellectual property. Your licence to use it is a limited, non-exclusive, non-transferable licence tied to your subscription.

Your gallery data — including artwork descriptions, photographs you upload, and collector information — remains yours.

7. Service availability

We aim to maintain high availability but do not guarantee uninterrupted service. Cloudflare's infrastructure provides substantial redundancy; however, scheduled maintenance or unexpected issues may cause temporary disruptions.

8. Limitation of liability

[REPLACE — final copy from legal] Our liability for any claim arising from your use of Galexivo is limited to the subscription fees paid in the three months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

9. Termination

You may cancel your subscription at any time from your account settings. We may terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.

Upon termination, your Cloudflare-hosted instance and its data remain intact and accessible to you — your subscription covers the management layer, not the underlying infrastructure, which is yours.

10. Changes to these Terms

We may update these Terms. We will notify you by email and post the update at galexivo.com/terms with a revised date. Continued use of Galexivo after the effective date constitutes acceptance.
